By accessing or using Akaun.Ai (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
Definitions
- "Service" means the cloud-based accounting platform provided by us, including the website, applications, APIs, and related features.
- "LHDN" means Lembaga Hasil Dalam Negeri (Inland Revenue Board of Malaysia).
- "PDPA" means the Personal Data Protection Act 2010 of Malaysia.
- "Subscription Period" means the period for which you have paid to use the Service.
- "User Data" means all data, content, and information (including personal information) uploaded to or stored in the Service by you.
1. Service Description
1.1 Platform Access
- Subscription-based cloud accounting software with LHDN e-Invoicing integration.
- Accessible via web browser and supported mobile applications.
1.2 Subscription and Payment
- Subscription fees may change with 30 days' notice.
- Automatic renewal unless cancelled at least 7 days before the next billing cycle.
- Service may be suspended after 15 days of non-payment.
2. Data and Privacy
2.1 Data Ownership
- You retain full ownership of all your business data.
- We adhere to PDPA requirements for data protection.
- We will not share your data with third parties without your consent, except as set out in our Privacy Policy.
2.2 Data Security
- Industry-standard security measures, including TLS in transit and encryption at rest for sensitive credentials.
- Regular backups.
- You are responsible for maintaining the confidentiality of your account credentials.

3.1 Support Availability
- Support provided through in-app ticket system during business hours.
- Premium support options available at additional cost.
3.2 Maintenance and Updates
- Scheduled maintenance is announced in advance where reasonably possible.
- Automatic updates are included in the subscription.
4. General Terms
4.1 Intellectual Property
- We retain all rights to the Service software.
- You receive a limited, non-exclusive, non-transferable right to use the Service during your Subscription Period.
- No reverse engineering, decompilation, or redistribution permitted.
4.2 Termination
- Either party may terminate with 30 days' notice.
- You may export your data for up to 30 days following termination.
4.3 Force Majeure
- Neither party is liable for delays or failure caused by events beyond reasonable control, including LHDN system outages, internet disruptions, and natural disasters.
4.4 Entire Agreement
- This agreement, together with our Privacy Policy, constitutes the entire agreement between you and us.
- No modifications are valid unless in writing and signed (or e-signed) by an authorised representative.
5. LHDN Integration
5.1 Integration Functionality
- LHDN system changes may affect synchronisation.
- Updates following LHDN modifications are provided on a best-effort basis.
- We may modify LHDN integration features as needed.
5.2 Audit Trail
- We provide data export functionality on a best-effort basis.
- Retention complies with Malaysian statutory requirements.
- Data extraction assistance may incur additional fees.
6. Liabilities and Disclaimers
6.1 Software Purpose
- The Service provides accounting tools only and is not professional accounting, tax, or legal advice.
- All outputs depend on your inputs and configuration.
- You are responsible for verifying all calculations.
- The Service is not a substitute for qualified accounting expertise.
6.2 Limitation of Liability
- Our total liability is limited to the fees paid by you in the 12 months preceding the claim.
- No liability for consequential, indirect, or business damages.
- The Service is provided "AS IS" without warranties of any kind.
6.3 No Indemnification
- Neither party indemnifies the other for third-party claims.
- Each party is responsible for its own legal defence.
6.4 User Responsibility
- You are responsible for data accuracy and the inputs you provide.
- You are responsible for compliance with applicable laws, including tax, accounting, and data protection.
6.5 Dispute Resolution
- Disputes are resolved through binding arbitration under the Malaysian Arbitration Act 2005.
- Governing law: laws of Malaysia.
- Class actions and jury trials are expressly waived.
6.6 Modifications
- We may modify these terms with 30 days' notice.
- Continued use of the Service after the effective date constitutes acceptance.
- Your sole remedy for disagreement is to terminate the Service.
